3. What are my data rights?

You have the right
a) to request information on the categories of processed data, processing purposes, possible recipients of the data, the planned storage period (Art. 15 GDPR);

b) to request correction or addition of inaccurate or incomplete data (Art. 16 GDPR);

c) to revoke consent at any time with future effect (Art. 7 para 3 GDPR);

d) to refuse data processing, which takes place on the basis of a legitimate interest, for reasons arising from your particular situation (Art. 21 para.1 GDPR);

e) to demand the deletion of data in certain cases in the context of Art. 17 of the GDPR – especially when the data are no longer required for the intended purpose or unlawfully processed, or you have revoked consent according to (c) above or have declared an opposition in accordance with (d) above;

f) to require under certain conditions the limitation of data, insofar as such deletion is not possible or the obligation to delete is in dispute (Art. 18 GDPR);

g) to demand data portability, i.e. you can receive your data that you have provided to us in the form of a standard machine-readable format such as CSV and if necessary submit to others (Art. 20 GDPR);

h) to lodge a complaint to the authorities about the data processing (for telecommunications contracts:) Federal Commissioner for Data Protection and Freedom of Information; in addition: Land Commissioner for Data Protection and Freedom of Information of North Rhine-Westphalia).

4. Who does the telecommunications my information to?

To data processors, these are companies that we hire within the predefined framework of the processing of data, Art. 28 GDPR (service provider, agents). Deutsche Telekom remains responsible in this case for the protection of your data. We hire companies in particular in the following areas: IT, sales, marketing, finance, consulting, customer service, human resources, logistics, print.

Due to legal obligations: In certain cases, we are legally obliged to transmit data to a requesting state authority.

5. Where are my data processed?

Your data will principally be processed in Germany and in other European countries.

Insofar as processing of your data in exceptional cases is transferred to countries outside the European Union (i.e. to so-called third countries), this will be done only with your express consent or is required for us to fulfill our services to you or it is provided by law (Art. 49 GDPR). Additionally, any processing of your data that occurs in third countries shall only take place, insofar as is ensured through specific measures, that an adequate level of data protection exists (e.g. the EU Commission’s adequacy determination or so-called appropriate safeguards, Art. 44ff. GDPR).

6. What data are collected and how is it used and how long is it stored?

a) Provision of the website and creation of log files
With each visit to our website our system automatically captures data and information from the system of accessing computer.

The following data are collected for this:

(1) information about the type of browser and version being used
(2) the user’s operating system
(3) the user’s internet service provider
(4) the IP address of the user
(5) date and time of access
(6) websites via which the user’s system access our internet page
(7) websites to which the user’s system gains access via our internet page

The log files contain IP addresses or other data that could enable attribution to the user. This could be the case, for instance, if personal data is contained within the link to the website from which the user gains access to the internet page or the link to the website that the user visits via our internet page.

The data are also stored in the log files of our system. Storage of this data along with other personal data of the user does not take place.

Purpose of the data processing
The temporary storage of the IP address by the system is necessary to enable the website to be delivered to the user's computer. For this purpose, the user’s IP address must be stored for the duration of the session.

It is stored in log files to ensure the functionality of the website. In addition, the data serve to optimize the site and to ensure the security of our information technology systems. An analysis of data for marketing purposes does not take place in this context.

Duration of storage
The data will be deleted when they are no longer necessary for the achievement of the purpose of their collection. In the case of the collection of data to allow access to the website, this is the case when that session is finished.

In the case of storage of the data in log files, this is the case no later than seven days. Storage for longer periods is possible. In this case, the IP addresses of users are anonymized so that attribution to the current client is no longer possible.

b) Contact form and email contact
Contact forms are available on our website that can be used for electronic contact. When a user takes advantage of this possibility, the data entered into the input mask are transmitted to us and stored. These data are:

At the time of the sending of the message, the following data is also stored:

We will ask your consent regarding the processing of the data upon transmission of the form and refer to this data protection declaration in the process.

Alternatively, it is possible to contact us via the email address provided. In this case, the personal data sent with the email of the user are stored.

Data processing is carried out by a third party selected and monitored by the person responsible in compliance with the statutory provisions by means of order data management. With the dispatch of the message, the person concerned simultaneously declares his consent to the disclosure of the above data to the third party named by the operator of this website (= order data manager). The data is used exclusively for processing the conversation.

Purpose of data processing
The processing of personal data from the input masks is only used by us alone for contact purposes. Also in the case of direct contact via email, there exists a required legitimate interest regarding the processing of this data.

Additional personal data processed in the sending of the online contact form serve to prevent misuse of the contact form and to ensure the security of our information technology systems.

Duration of storage
The data will be deleted when they are no longer necessary for the fulfillment of the purpose of their collection. For the personal data from the input mask of the contact form and those sent by email, this is the case when the respective conversation with the user is finished and a follow-up of the respective inquiry is no longer necessary. The conversation is terminated when it can be inferred from the circumstances that the facts in question have been sufficiently clarified.

Tracking is no longer necessary if the conversation took place so long ago that it can be assumed that recourse to its content is no longer necessary.

Deletion of conversations occurs usually after 24 months if no statutory obligations prevent such deletion.

c) Materials ordering System
On our website, we offer users the possibility to order materials and use personal data for this purpose. The data are entered into an input mask by the user and submitted to us and at which point we store the data. The following data are collected in the ordering process:

(1) salutation, first name, last name
(2) street address
(3) postal code, city/locality
(4) email address
(5) establishment/Institution

The data processing is carried out by a third party selected and monitored by the person responsible in compliance with the statutory regulations by means of order data management. When ordering materials, the data subject simultaneously declares his consent to the forwarding of the above data to ensure shipment.

Purpose of data processing
The user’s details are required for the processing of the order process and the delivery of the order. These include:

(1) storage of specific collections of materials
(2) organization and implementation of the ordering process
(3) possibility of contacting and enquiry regarding the order
(4) shipment of materials
(5) securing delivery
(6) notifications of new issues

Duration of storage
The data will be made completely anonymous as soon as they are no longer necessary for fulfillment the purpose for which they were collected.

7. Data control for social media plug-ins used

We use social plug-ins from the social networks Facebook, Twitter and YouTube on our website in order to make our offers better known, in accordance with Art. 6 para. 1 lit. f. GDPR. The underlying advertising purpose is to be regarded as a legitimate interest within the meaning of the GDPR.

Responsibility for data protection-compliant operation must be guaranteed by the respective provider.

Purpose of data processing

a) Facebook
Our website uses social media plugins from Facebook to personalize their use. For this we use the "LIKE" or "SHARE" buttons. This is an offer from Facebook.

When you access a page of our website that contains such a plugin, your browser establishes a direct connection to the Facebook servers. The content of the plugin is transmitted directly from Facebook to your browser and integrated into the website.

By integrating the plugins, Facebook receives the information that your browser has called up the corresponding page of our website, even if you do not have a Facebook account or are not currently logged on to Facebook. This information (including your IP address) is transmitted directly from your browser to a Facebook server in the USA and stored there.

If you are logged in to Facebook, Facebook can directly associate your visit to our website with your Facebook account. If you interact with the plugins, for example by pressing the "LIKE" or "SHARE" button, the corresponding information is also transmitted directly to a Facebook server and stored there. The information is also published on Facebook and displayed to your Facebook friends.

Facebook may use this information for the purposes of advertising, market research and demand-oriented design of Facebook pages. b) Twitter

When you access a page of our website that contains such a plugin, a direct connection is established between your browser and the Twitter server. Twitter receives the information that you have visited our site with your IP address. If you click the Twitter "tweet button" while logged into your Twitter account, you can link the contents of our pages on your Twitter profile. This allows Twitter to associate the visit of our pages with your user account. We would like to point out that, as the provider of the pages, we are not aware of the content of the data transmitted or how it is used by Twitter.

c) YouTube
We have integrated components from YouTube on this website. YouTube is an internet video portal that allows video publishers to post video clips and other users to view, rate and comment on them free of charge. YouTube allows the publication of all types of videos, which is why complete film and television programs, music videos, trailers or videos produced by users themselves can be accessed via the Internet portal.

Each time one of the individual pages of this website is accessed, which is operated by the data controller and on which a YouTube component (YouTube video) has been integrated, the internet browser on the information technology system of the person concerned is automatically prompted by the respective YouTube component to download a representation of the corresponding YouTube components from YouTube. More information about YouTube can be found at In the course of this technical procedure, YouTube and Google are informed which specific subpage of our website is visited by the person concerned.

If the person concerned is logged on to YouTube at the same time, YouTube recognizes which specific subpage of our website the person concerned visits by accessing a subpage that contains a YouTube video. This information is collected by YouTube and Google and assigned to the respective YouTube account of the person concerned.

YouTube and Google receive information via the YouTube component that the person concerned has visited our website whenever the person concerned is logged on to YouTube at the same time as accessing our website; this happens regardless of whether the person concerned clicks on a YouTube video or not.

If you do not want YouTube to associate the information collected through our website directly with your Google account, you must log out of YouTube before visiting our website.

8. Is my usage behavior evaluated, e.g. for advertising, tracking or fraud prevention?

a) Use of Cookies
Our website uses cookies. Cookies are text files that are stored in the internet browser or by the internet browser on the user’s computer system. If a user visits a website, a cookie may be stored on the user’s operating system. This cookie contains a characteristic character string that enables a unique identification of the browser when the website is called up again.

b) Web analysis by Matomo (formerly PIWIK)
On our website we use the open source software tool Matomo (formerly PIWIK) to analyze the online behavior of our users. The software places a cookie on the user’s computer (see above for cookies). If individual pages of our website are accessed, the following data are stored:

(1) two bytes of the IP address of the visiting user’s system
(2) the accessed website
(3) the URL of the website from which the user has accessed the current website
(4) the sub-pages accessed from the accessed website
(5) time spent on the website
(6) frequency of website access
(7) system information of the user

The software runs exclusively on a server in a German data center that is specially operated for data protection-compliant web analysis. The personal data of users is only stored there. The data processing is carried out by a third party selected and monitored by the person responsible in compliance with the statutory provisions by means of order data management.

The software is set so that the IP addresses are not completely stored, instead 2 bytes of the IP address are masked (e.g..: This way, it is no longer possible to assign the shortened IP address to the accessing computer.

Purpose of data processing
The processing of users’ personal data enables us to analyze the website use of our users. We are in a position to compile information about the use of the individual components of our website by evaluating the data obtained. This helps us to continuously improve our website and its user-friendliness. For these purposes, it is also in our legitimate interest to process the data in accordance with Art. 6 para. 1 lit. f GDPR. By anonymizing the IP address, the users’ interest in protecting their personal data is sufficiently taken into account.

Duration of storage
The data will be deleted as soon as they are no longer needed for our recording purposes. In our case this is the case after termination of the service offered via the website (i.e. after the completion of the internet offer of the Medienführerschein Bayern).
